Filing boundary
Botswana has no universal filing channel or verified public submission, payment, case-status or decision API. The Constitution, gazetted Acts and amendments, commencement instruments, regulations, binding decisions and rules control over directives, guidance and forms. e-Laws is the designated current-law repository but was unavailable; use the Government Printer and responsible authority as fallbacks. Monitoring is not configured. The Immigration Act Cap. 25:02, Act 3 of 2011 remains the primary migration framework. The Refworld 2011 record attaches the revoked 1966 Act and is a conflict record, not the current consolidation. No current consolidation, 2014 visa regulations or claimed 2017 amendment was retrieved, so an operational pack remains blocked pending controlling instruments or authority confirmation. eVisa is an applicant-controlled browser portal for application and status viewing, not a reusable public API. Visa, extension and border guidance must be checked for travel date, nationality, passport class, purpose, authority and channel. Official transit material conflicts among three-day, seven-day and transporter-related fourteen-day language. A visa, upload, receipt or approval letter does not guarantee admission, residence or work permission; the applicant retains every account, signature, passport, endorsement, border and collection stage. Work permits are administered separately from residence permits and neither approval establishes the other. Employer, worker and professional-clearance duties remain distinct. The published work-permit appeal is an administrative route and must not be substituted for a court remedy. Permanent-residence guidance conflicts on 56 working days versus six months and on the general five-year basis versus earlier investor language; current law, evidence, fee, decision authority and remedy must be confirmed live. Citizenship, national registration, passport, immigration status and residence are separate. The Citizenship Amendment Act 23 of 2024 changed age-21 renunciation provisions. Act 30 of 2025 was assented to, but the latest ministry record said regulations were still being finalized and commencement would follow; no Gazette commencement instrument or completed regulations were located. Do not operationalise multiple citizenship or newer routes. Legacy service pages, Form N, oaths and renunciation wording require reconciliation. National Registration Amendment Act 7 of 2025 does not itself prove citizenship. The Refugees (Recognition and Management) Act 20 of 2024 provides for commencement by notice. A minister reported 1 November 2025 commencement in a Parliament Hansard, not a controlling instrument; no Gazette notice or implementing regulations were located, while dated international material conflicts. Preserve the reported date as unsealed and use the controlling instrument before treating the new structure as operative. Asylum intention and protection narratives require human safety triage and must never be auto-transmitted; UNHCR does not receive or decide Botswana claims. The Employment and Labour Relations Act 27 of 2025 was officially announced as effective on 1 July 2026, but no Gazette commencement order or completed regulations were located. Apply event-date and transitional analysis and do not use the new framework retroactively or assume every institution and process is operational. The National Migration Policy was still scheduled for Parliament before implementation in the 23 March 2026 official update and is not operative law or policy. National, customary and Kgotla processes, local and tribal authorities, Land Boards, district offices and specialist forums have distinct jurisdiction and remedies. Land Tribunal pages conflict between finality language and an eight-week High Court appeal; verify the statute, decision, service date, leave, deadline and stay. A civil, land, labour, company, tax, customs, AML, procurement, competition, IP or professional record never establishes immigration status or another authority's approval. The Data Protection Act 2024 commenced on 14 January 2025 according to the reviewed official record; older official pages host draft or 2018 material and are not current law. No Gazette commencement orders were verified for the Cybersecurity or Digital Services Acts 2025. Apostille records are document-specific. Statutory Instrument 34 of 2020 was revoked by Statutory Instrument 61 of 2020 and is historical only. A lawyer's roll, practising certificate, membership and accepted mandate do not authorize another person's account, personal declaration, asylum intention, biometrics, interview, oath, fee or collection stage. This research-only release activates no pathway, eligibility decision, form-preparation pack, source monitoring, fee engine, representative filing, portal action, payment, transmission, legal advice, or government submission.
Representative participation
Representation is route-, authority-, actor-, account-, forum-, standing-, mandate-, date-, source-health- and personal-stage-specific. An applicant may act personally where the controlling route permits and may engage a Botswana attorney for a defined review or representation scope. Legal practice requires the applicable High Court enrolment, a current practising certificate issued through the Registrar and current Law Society membership; verify the 2026 register, certificate, disciplinary status, conflicts, subject-matter and forum authority, identity and the receiving authority's accepted mandate. Law Society directory pages require content-integrity filtering and do not alone prove current standing. Customary, Kgotla, tribunal, land, administrative and court proceedings retain their own appearance and representation rules. No attorney, employer, sponsor, family member, immigration consultant, company agent, notary, accountant, AI system or platform has universal filing authority. A retainer, power of attorney, directory entry, professional licence or portal role never transfers another person's credentials or replaces a stage assigned personally to an applicant, traveller, asylum seeker, citizen, worker, employer, company officer or other actor. eVisa and other government, labour, company, tax, customs, land and court systems are actor- and account-bound; no reusable public submission, payment, monitoring or decision API was verified. The assigned actor retains every required account, declaration, signature, original, passport, biometric, interview, oath, appearance, police or medical evidence, fee authorization, service and collection stage. Never share credentials, CAPTCHA responses or one-time codes; impersonate an account holder; initiate government payment; or treat an upload, receipt, visa, permit, registration, certificate, status result or professional listing as approval of another legal status. Recheck current law, authority, standing, mandate, form, evidence, signature, fee, channel, deadline, receipt, decision, stay and remedy before action.
