Filing boundary
Azerbaijan has no universal immigration, visa, border, citizenship, protection, civil, business, tax, property, professional, appeal, payment, or filing channel, and no public government submission API was verified. Current Azerbaijani-language consolidated E-Qanun texts control over State Migration Service, MFA, ASAN, Justice, tax, and other summaries; older English translations, PDFs, FAQs, static fee tables, and editorial errors are subordinate. Enacted law controls substantive requirements. Current authority portals and specific dated notices control live channels and availability only within that law. Route, nationality, direction, passport type, effective date, source health, actor, account, form edition, and personal stage must be checked at use time. Temporary 2026–2027 visa waivers and land-border operations are high-change. Air entry is available; ordinary land entry generally requires Operational Headquarters permission, while foreign nationals may depart by land and the Baku–Tbilisi rail exception from 25 May 2026 is limited to the stated eligible classes. Do not generalize it to every land crossing. A consular visa, waiver, invitation, electronic visa, residence ground, PASS recognition, property interest, business registration, or professional credential never guarantees border admission, work, residence, or another status. Electronic visas are generally single-entry visitor permissions and do not authorize paid work. Current SMS guidance uses a 15-day stay-registration rule and a 30-day Kazakhstan exception; the e-visa FAQ's ten-day statement is stale. Host or accommodation duties, foreigner self-service, address changes, deregistration, and re-entry are separate. Temporary and permanent residence grounds, investment and property thresholds, continuity, child consent, language or rights testing, exemptions, filing lead times, and card terms require current-law review. The residence page contains an editorial cancellation error and older ASAN pages omit newer highly skilled and securities routes. The employer is the work-permit actor; exemptions do not create residence. The PASS highly skilled program is active under its 2026 criteria and personal cabinet, not a future or representative-controlled filing. Current State Fee law controls the stale MFA invitation fee and older SMS, ASAN, citizenship, civil-status, tax, and company-fee pages; never hardcode a fee, processing time, quota, threshold, or exemption without a current check. Citizenship admission, restoration, renunciation, foreign-citizenship notice, court-determined loss, child consent, and the personal oath are distinct. Birth in Azerbaijan is not universally territorial citizenship. Citizenship-affiliation determination is not a general statelessness-determination route. Political asylum exists constitutionally, but no public application checklist was verified. Refugee protection is distinct from the domestic IDP regime. Refugee-law and Migration Code language conflict on whether removal review suspends action; every removal, detention, deadline, and interim-relief matter requires urgent human legal review based on actual service and current special law. Generic electronic appeals do not replace dedicated administrative-proceeding channels. Foreign civil records may require translation, notarization, apostille, or legalization; MOJ, MFA, Nakhchivan, consular, civil-status, passport, ID, marriage, and notarial actors remain distinct. Current Justice fee guidance controls older civil-service material. Entity, branch, nonprofit, beneficial-owner, tax, VAT, payroll, social-insurance, e-employment, license, permit, investment-promotion, property, land, diploma, health, Bar, and notary processes are separate from immigration. Foreign persons generally lease rather than own land, and inherited, gifted, or mortgaged land generally must be alienated within one year; building ownership creates no immigration right. Beneficial ownership requires a human factual and legal control determination. The nonresident digital-services VAT rule effective 1 September 2026 remains future-only until commencement. Bar English material stating three years of experience is superseded by current law and the current Azerbaijani admission page stating one year; source health must be rechecked because Bar pages have returned errors. Portal entry, credentials, factual attestation, identity, originals, signature, consent, payment, appointment, interview, examination, medical step, biometrics, civil or notarial act, oath, ceremony, final submission, notice, decision, and collection are manual actor-controlled handoffs. This release activates no pathway, eligibility decision, form-preparation pack, monitoring, fee engine, representative filing, portal action, payment, transmission, or government submission.
Representative participation
Representation is route-, authority-, actor-, account-, and stage-specific. Consular visa guidance permits the applicant or an authorized representative to lodge at a mission, and a legal-entity invitation representative must prove authority and identity. Temporary-stay extension and residence applications may be made by the applicant or a legal representative; children use parent or legal-representative rules and retain any required consent or signature. These provisions do not make every attorney a statutory legal representative. Stay registration assigns duties to the accommodation operator, property owner, or host even though the foreigner may self-register. The employer, not the worker or applicant counsel, is the work-permit applicant, payer, and permit recipient. PASS is filed through the foreigner's personal cabinet; employer access is consent-based. Company founders, legal representatives, officers, beneficial-owner declarants, taxpayers, employee and employer e-signers, civil-status parties, parents, notaries, advocates, and regulated professionals each retain their assigned authority. A power of attorney cannot replace Bar membership or a reserved notarial or professional act. Applicant facts, identity, originals, portal credentials, declarations, signatures, consent, payment authorization, marriage attendance, passport or ID photo and fingerprints, refugee interview, dactyloscopy and medical steps, residence tests, professional exams and training, court testimony, citizenship oath, biometrics, card collection, border inspection, and sovereign, administrative, or judicial decisions remain personal or authority-controlled. Confirm current law, mandate, signatory, account holder, legalization, translation, appointment, fee, receipt, and personal-stage rules for every action. Never share or automate applicant, representative, host, employer, PASS, migration, MFA, ASAN, tax, e-social, court, notary, or regulator credentials.
